APTEL Rules in Favor of Solaire Surya Urja to Refund LD For 140 MW Solar Projects

The Appellate Tribunal for Electricity (APTEL) has ruled in favor of Solaire Surya Urja Private Limited, a solar developer in Rajasthan, in a dispute against NTPC Limited regarding the delayed commissioning of 140 MW solar projects. The company faced delays due to the absence of evacuation infrastructure, which was the responsibility of Rajasthan Rajya Vidyut Prasaran Nigam Limited (RRVPNL).

Despite repeated requests, the infrastructure was not ready on time, preventing power injection into the grid. NTPC imposed liquidated damages, and the Central Electricity Regulatory Commission (CERC) initially ruled against Solaire Surya Urja in 2021. However, APTEL reviewed the case and determined that the delay was beyond the developer’s control, granting an extension under force majeure provisions and ordering NTPC to refund any penalties collected.
